HIPAA Notice of Privacy Practices

This notice describes how medical information about you may be used and disclosed and how you can get access to this information. Please review it carefully.

Our commitment to your privacy

My Niche Therapy is committed to protecting the privacy of your Protected Health Information (PHI) as required by the Health Insurance Portability and Accountability Act (HIPAA), the HITECH Act, applicable California laws (including the CMIA and Lanterman-Petris-Short Act), and 42 CFR Part 2 for substance use disorder records where applicable.

How we may use and disclose your PHI

Treatment

We may use your PHI to provide, coordinate, or manage your care, including consultation with other providers involved in your treatment.

Payment

We may use your PHI to obtain payment for services, including verifying insurance coverage and submitting claims when authorized.

Health care operations

We may use your PHI for quality improvement, staff training, licensing, and other activities necessary to run our practice.

As required or permitted by law

  • Reporting suspected abuse of a child, elder, or dependent adult.
  • Reporting serious threats to the health or safety of you or others.
  • Responding to valid court orders, subpoenas, or law enforcement requests.
  • Public health activities and health oversight audits.

Uses that require your written authorization

  • Most uses of psychotherapy notes.
  • Marketing communications.
  • Any sale of PHI (which we do not engage in).
  • Disclosure to family, friends, or third parties not otherwise permitted by law.

You may revoke an authorization in writing at any time, except for actions already taken in reliance on it.

Your rights

  • Access: You may request to inspect or receive a copy of your record.
  • Amendment: You may request corrections to information you believe is inaccurate.
  • Accounting of disclosures: You may request a list of certain disclosures we have made.
  • Restrictions: You may request restrictions on certain uses or disclosures.
  • Confidential communications: You may request that we contact you in a specific way or at a specific location.
  • Breach notification: You will be notified if a breach of your unsecured PHI occurs.
  • Paper copy: You may request a paper copy of this notice at any time.

Our responsibilities

  • We are required by law to maintain the privacy and security of your PHI.
  • We will notify you promptly if a breach compromises the privacy or security of your PHI.
  • We must follow the practices described in this notice currently in effect.

Telehealth

Telehealth sessions are conducted on HIPAA-compliant platforms with encryption in transit and at rest. You are responsible for participating from a private location of your choosing.

Substance use disorder records (42 CFR Part 2)

Where applicable, substance use disorder records receive additional federal protections and cannot be disclosed without your specific written consent, except in limited circumstances defined by law.

Changes to this notice

We may change this notice at any time. Changes apply to all information we already have about you as well as any we receive in the future. The current notice will always be posted at mynichetherapy.com/hipaa.

Filing a complaint

If you believe your privacy rights have been violated, you may file a complaint with us at info@mynichetherapy.com or with the U.S. Department of Health & Human Services, Office for Civil Rights. We will not retaliate against you for filing a complaint.
